Terms of Service

These Terms of Service ("Terms") govern your use of the website allnew.homes ("Site") operated by PolyFront LLC ("we," "us," or "our"), a Florida limited liability company. By accessing or using the Site, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Site.

1. Eligibility

You must be at least 18 years of age and a resident of the United States to use the Site. By using the Site, you represent and warrant that you meet these requirements.

2. Account Registration

You may create an account using your email address or by signing in through Google or Apple. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us promptly if you suspect unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Service

The Site is a real estate listing platform that displays new home construction listings on an interactive map. The Site aggregates publicly available listing data from third-party home builder websites and presents it in a searchable, filterable format.

The Site allows you to:

  • Browse new home listings on an interactive map
  • Filter listings by price, bedrooms, bathrooms, square footage, and home type
  • Save home listings to your account (up to 20)
  • Save your filter preferences

4. Data Accuracy Disclaimer

Home listing data displayed on the Site is sourced from third-party builder websites and is not independently verified by PolyFront LLC.

  • Listing prices, availability, floor plans, lot sizes, and other details may be inaccurate, outdated, or incomplete.
  • Listings may be removed or expire without notice.
  • We do not guarantee the accuracy, completeness, or timeliness of any listing data.
  • Always verify listing details directly with the builder or their authorized representative before making any purchasing decision.

5. Fair Housing Act Compliance

We are committed to compliance with the Fair Housing Act (42 U.S.C. §§ 3601–3619) and all applicable federal, state, and local fair housing laws.

All home listings displayed on the Site are subject to the Fair Housing Act, which makes it illegal to discriminate in the sale, rental, or financing of housing based on race, color, national origin, religion, sex, familial status, or disability.

We do not filter, sort, rank, or exclude listings based on any protected characteristic. If you believe any content on the Site violates fair housing laws, please contact us immediately at admin@allnew.homes.

6. Intellectual Property

  • Builder Content: Home listing data, images, floor plans, and descriptions originate from third-party builders and remain the intellectual property of their respective owners. We display this content under fair use for informational purposes.
  • Site Content: The Site's design, layout, code, and original content are the property of PolyFront LLC and are protected by applicable intellectual property laws.
  • Trademarks: Builder names and logos displayed on the Site are trademarks of their respective owners and are used for identification purposes only.

You may not copy, reproduce, distribute, or create derivative works from the Site or its content without our prior written consent.

7. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to the Site, its servers, or any associated systems
  • Scrape, crawl, or use automated means to access the Site without our written permission
  • Interfere with or disrupt the Site's operation or the servers and networks that host it
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use the Site to transmit spam, malware, or other harmful content

8. Limitation of Liability

PolyFront LLC is not a real estate broker, agent, or advisor. The Site is an informational platform only. We do not:

  • Facilitate real estate transactions
  • Provide real estate advice or recommendations
  • Guarantee the availability or pricing of any listing
  • Represent or act on behalf of any builder, buyer, or seller

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLYFRONT LLC AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

9. Disclaimer of Warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Indemnification

You agree to indemnify, defend, and hold harmless PolyFront LLC and its officers, directors, members, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Site at any time, with or without cause, and with or without notice. Upon termination, your right to use the Site ceases immediately.

You may delete your account at any time by contacting us at admin@allnew.homes. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.

Any dispute arising out of or related to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Florida. You consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

If we make material changes, we will provide notice through the Site or by email.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PolyFront LLC regarding your use of the Site.
